미주총연 김재권 총회장” 승소판결 나와 이정순 회장 쪽에 “미주총연 총회장 명칭 사칭할 수 없어” 명령
[하이코리언 뉴스] 지난 10개월 동안 지속돼 왔던 미주한인회총연합회 분규사태 관련 소송에서 김재권 총회장 쪽이 승소했다.미국 워싱턴DC에 있는 페어팩스 카운티 법원의 캐롤 판사는 3월21일(현지 시간) “오늘 이후 이정순 회장은 어떠한 곳에서도 미주총연 총회장의 명칭을 사칭할 수 없으며 총연 사무실 및 모든 비품, 은행 계좌, 총연 로고 등을 김재권 총회장에게 인수인계하라”고 판결했다. 캐롤 판사는 미국 버지니아에 있는 미주총연 본부 사무실 열쇠를 (김재권 총회장에게) 인계하라고 명령하기도 했다.

미주총연 분규는 지난해 5월 시작됐다. 미주총연 조정위원회가 지난해 5월16일 미국 LA가든 스위트호텔에서 임시총회를 개최하고 김재권 전 미주총연 이사장을 총회장으로 선출했지만, 이정순 회장 쪽도 일주일 뒤인 5월23일 미국 시카고 윈담 글렌뷰호텔에서 총회를 열고 이 회장의 연임을 결정했다. 캐롤 판사는 판결문을 통해 조정위원회의 LA총회는 합법적으로 열렸고, 정회원 참석자가 부족했던 이정순 회장 쪽의 시카고 총회는 불법적으로 개최됐다고 밝혔다.
김재권 총회장은 미주총연 각 회원들에게 SNS 등으로 이렇게 알리고 “250만 미주동포를 대표하는 미주총연의 당락이 미국 법원의 판결로 이뤄지는 일은 이번이 마지막이 되기를 바란다. 미주총연에 대한 동포 여러분들의 관심을 보내주길 바란다”고 밝혔다.

FINAL ORDER
THIS MATTER COMES BEFORE The court on the Complaint of the Plaintiff,
THE FEDERATION OF KOREAN ASSOCIATIONS, USA (“the Federation”), by its counsel in Civil Action No. 2016-6846, against defendant Chaung Soon Lee (“Ms. Lee”), who filed an answer thereto, and the appearance of the parties on March 21, 2016;
AND IT APPEARING THEREFROM that the Complaint is well-taken, the Court hereby makes the following findings;
(i) That the Los Angeles Convention was properly noticed and organized on May 16,2015,and
(ii) That Mr. Jae Kwon Kim was duly elected president of the Federation at the Los Angeles Convention;
(iii) That Mr. Kim assumed the role as President on Jul 1,2015and remains the President to date;
(iv) That no objection to his election was timely filed with the Election of Arbitration Committees;
(v) That the Chicago convention called by Ms. Lee failed to achieve a quorum at its purported meeting on May 23, 2015;
(vi) That no person was elected at the Chicago convention.
(vii) WHEREFORE, having made those factual finding, the Court hereby
ADJUDGES, ORDERS AND DECREES as follows;
(i) That Ms. Lee is hereby ENJOINED from
a. Representing herself as “the resident” of the Federation, either to its membership, the media or representatives of the Republic of Korea;
b. Using the Federation’s seal, stationery or logos;
c. Keeping custody of the Federation’s records, files, files, bank accounts or using its headquarters located in Fairfax County;
(ii) That Ms. Lee is hereby ORDERED to
(iii) a. Provide immediate access to the above records and accounts;
(iv) b. Turn over the keys to the headquarters building.
